    These terms and conditions contain the agreements and conditions of use that regulate the use of the website www.tribulatam.com , owned by TRIBU Tech Latam LLC , with commercial registration number 88-3181607, with registered office at 7925NW 12Th ST STE 109 Doral, 33126 FL, (hereinafter "TRIBU TECH LATAM").

    Please read this document carefully before accessing and using the website www.tribulatam.com .

    By accessing and using it, you express your acknowledgment and acceptance of the following terms and conditions of use.

  • Terms and Conditions

    Access to and use of the website provides the User with diverse information about the different services or plans offered by TRIBU TECH LATAM, as well as the possibility of contracting them.

    TRIBU TECH LATAM brings together tech leaders from Latin America.

    Community membership is not free: to be part of TRIBU TECH LATAM, the User must subscribe to one of the available membership plans.

    Membership Plans

    Base Plan - USD 15/month
    Includes:
    - In-person networking activities throughout LATAM.
    - Monthly online technical and non-technical training.
    - Ability to post or apply for Job Opportunities.

    DOMOS Plan - USD 50/month + One-time Enrollment Fee of USD 190
    Includes:
    - In-person networking activities throughout LATAM.
    - Monthly online technical and non-technical training.
    - Promote yourself and your company.
    - Find colleagues for business alliances.
    - Ability to post or apply for Job Opportunities.
    - Join the DOMOS.

    The DOMOS Enrollment Fee is paid in a single payment at the time of confirming participation.
    Payments and invoices can be made by the company, by the individual, or in a mixed format.
    Payments must be made within 10 (ten) days after the invoice is issued.
    To reserve a spot in a DOMO, it will be necessary to:
    - Approve the present Code of Conduct .
    - Approve the Confidentiality Agreement (NDA) .
    - Go through the validation process defined by TRIBU TECH LATAM.

    Confidentiality Agreement (NDA) for DOMOS

    Participation in a DOMO implies automatic acceptance of the Confidentiality Agreement, the provisions of which are mandatory for all members:

    • Purpose: Participation in DOMOS implies access to a professional and confidential exchange space among up to 15 members.
    • Confidential Information: All information, data, documents, technical knowledge, trade secrets, ideas, strategies, plans, products, clients, or any other information shared within a DOMO is considered strictly confidential.
    • Member Obligations:
      • a) Maintain such information in strict confidentiality.
      • b) Not disclose it to third parties without the express written authorization of the member who provided it.
      • c) Use the information only for purposes related to DOMO activities.
      • d) Protect the information with the same degree of care as their own confidential information.
      • e) Limit access exclusively to DOMO members.
      • f) Immediately notify TRIBU TECH LATAM of any unauthorized disclosure incident.
    • Exceptions:
      • a) Was in the public domain at the time of disclosure or later without breach of this agreement.
      • b) Was lawfully obtained from a third party not subject to confidentiality obligations.
      • c) Was already in the member's possession before disclosure, provided they can prove it conclusively.
    • Duration: The confidentiality obligations will remain in effect during membership in the DOMO and for two (2) years after the member's departure.
    • Governing Law and Jurisdiction: This confidentiality agreement shall be governed by and construed in accordance with the laws of the United States. Any dispute shall be submitted to the courts of the state of Delaware, to whose jurisdiction the parties submit.

    Non-compliance with these obligations may result in immediate suspension or cancellation of DOMO membership, without prejudice to any legal actions that may apply.

    Code of Conduct for DOMOS

    All DOMOS members must comply with the following Code of Conduct:

    • Respect and Diversity: We foster an inclusive, respectful, and discrimination-free environment. We value diversity of opinions, experiences, and personal characteristics. We treat all members, collaborators, and partners with respect, consideration, and courtesy, regardless of their race, ethnicity, gender, sexual orientation, religion, disability, or other characteristic.
    • Ethics and Honesty: We act ethically, transparently, and honestly in all our interactions and transactions. We comply with applicable laws, regulations, and standards. We do not tolerate dishonest, fraudulent, or deceptive behavior.
    • Confidentiality and Information Protection: We respect the confidentiality of information shared in DOMOS and are committed to protecting it appropriately. We do not disclose information to third parties without authorization.
    • Safe and Respectful Environment: We promote a safe, healthy, and respectful environment. We do not tolerate harassment, intimidation, violence, or inappropriate behavior. We report any incident promptly and support those affected.
    • Compliance with Policies and Procedures: We comply with TRIBU TECH LATAM's internal policies, procedures, and regulations, including information security and proper use of resources.
    • Collaboration and Teamwork: We promote collaboration and knowledge sharing. We respect the opinions and contributions of other members, seeking the personal and professional growth of all.
    • Responsible Use of Resources: We use TRIBU TECH LATAM's resources responsibly, avoiding inappropriate use, waste, or abuse of material, financial, and technological resources.
    • Conflict of Interest: We avoid situations where personal interests may influence decisions or actions to the detriment of the community. We disclose actual or potential conflicts and act in the best interest of the organization.
    • Updates and Compliance: We recognize that this Code of Conduct may be updated. We are committed to reading, understanding, and complying with established policies and guidelines.

    Non-compliance with this Code of Conduct may result in immediate suspension or cancellation of DOMO membership, without prejudice to any legal actions that may apply.

    User Obligations
    The User shall have the following obligations:

    • Not to enter malicious code of any kind on the website.
    • Not to use the website for illegal, deceptive, malicious, or discriminatory acts.
    • Not to take any action that could disable, overload, or affect the proper functioning or appearance of the website.
    • Not to provide false information.
    • Not to publish content or take any action on the website that infringes or violates the rights of third parties or that violates any regulations.
    • Not to use the trademarks, distinctive signs, trade names, copyrights, or any other intellectual or industrial property rights, except with the prior written consent of TRIBU TECH LATAM.
  • User Account Creation and Database Registration

    The User may create an account on the website. When registering and creating a password, the User will be responsible for making diligent use of said password.

    Users who register on the platform will be part of a database managed by TRIBU TECH LATAM.

    During the registration process, users may choose to receive job opportunities offered through TRIBU TECH LATAM's Talent service. By checking this option, users agree that their registration information may be shared with companies that contract said service, for the sole purpose of offering them job opportunities.

  • Confidentiality

    At TRIBU TECH LATAM we respect privacy rights and recognize the importance of protecting personal information. For this purpose, we invite you to consult our Privacy Policy at www.tribulatam.com/en/privacy-policy .

  • Limitation of Liability

    In no event shall TRIBU TECH LATAM or its related parties, shareholders, subsidiaries, officers, directors, employees, contractors, or suppliers be liable to users for any incidental, consequential, direct, or indirect damages arising from or related to the use of the website.

  • Intellectual Property Rights, Trademarks, Software

    All intellectual property rights of the website, as well as the elements contained therein, are the exclusive property of TRIBU TECH LATAM. Consequently, the User may not use any of the aforementioned content for commercial purposes.

  • Governing Law

    Any doubt or conflict arising from these terms and conditions shall be interpreted in accordance with the laws of the United States, and any dispute shall be submitted to the courts of the state of Delaware, to whose jurisdiction the parties submit.

  • Amendments

    TRIBU TECH LATAM may make modifications to the Terms and Conditions of the website and will notify the User of them within a period of 10 (ten) business days after making such modifications. The User's continued use of the website constitutes acceptance of the modifications.
